Legal Advice


First off we must warn you that this section is not devised by a lawyer, we will change this when we get our lawyer to write an article on legal issues. Having said that this is advice we have gleaned from people who know the Law and our own experiences.

The first point we cannot stress enough is that you do get a lawyer if you find yourself in the position of being falsely accused, at this stage we are assuming you are totally innocent, if not there is nothing we can do for you or would want to do to help you.

Unfortunately by the time you read this it may be too late and you will be out on bail or a member of your family or friend, but in case this is not so you must realise sadly that the law only wants to prove their case not to disprove and any thing you say in interview will more than likely be twisted and used against you.

We are campaigning to turn this around but feel it will be a very long time before we succeed. At our first meeting of Faascotland we were told by experts just how much pressure the police are under to get convictions and if the innocent get caught up in it so be it, figures are all that matter.

Scottish law is very different than English law in so much as the police can interview you for six hours before you can have a lawyer and then only if they detained you at the beginning of the six hour interview. So you will have to follow the points to remember listed below always remember you have rights too.

1. At start of interview ask to be detained.
2. Ask for writing material so you can write down the things you are asked it will prove useful to you finding out how all this came about in the first place.
3. Ask for full disclosuer before you answer any thing at all.
4. You can stop the interview at any time to gather your thoughts
5. Most important no matter how you feel you must say no comment to any thing asked for the full six hours till you get a lawyer and don't forget you do need a lawyer.
